Terms of Service for Remote Access Support
Last updated on April 01, 2025As part of providing support for Elsevier subscribed products and services, Elsevier may provide support via Internet remote access, whereby it will access, control and gather information on your computer through the installation and use of remote access software. Installation and use of the remote access software indicates your permission for Elsevier to provide support in this way. All or portions of the remote access software files may remain on your computer after the support session is finished. Title to the remote access software and all intellectual property rights included therein remains with Elsevier and/or its licensors.
Use of the applicable remote access software is subject to the additional Terms of Use below.
Customer may not disassemble or reverse engineer any portion of the remote access software. While remote access support services are provided, Elsevier will only access, control and gather information on your computer that it reasonably believes is necessary to analyse and help with the support incident. Elsevier recommends closing all files and applications that are not pertinent to the support incident. The remote access software or the features of your computer will allow you to terminate the remote access support service session at any time. Elsevier may be obligated as a matter of law and policy to report to law enforcement certain images if viewed during a session.
Personal data collected and processed by Elsevier through the provision of the remote access support services will be subject to the Elsevier Privacy Policy. The session may be recorded for purposes of supervision, training, quality assurance and product improvement.
Terms of Use
PLEASE REVIEW THESE TERMS OF USE CAREFULLY. BY CLICKING "I HAVE READ AND AGREE TO THE TERMS ABOVE" OR BY CONTINUING TO USE THIS APPLICATION, YOU, INDIVIDUALLY AND AS AN AUTHORIZED REPRESENTATIVE OF YOUR ORGANIZATION AGREE TO THE TERMS OF USE SET FORTH BELOW.
1. BeyondTrust Corporation's ("BeyondTrust") Remote Support Software (the "Software") has been or is about to be downloaded to your computer to allow a remote control session between an operator of Elsevier B.V. or any of its affiliated companies ("Elsevier") and a computer or computers on your network. By clicking "I have read and agree to the terms above," you are authorizing a remote operator of Elsevier to download the Software to your computer and you understand that the permitted operator will have partial or fully unrestricted access to gain access to this computer or computers on your network as well as their contents on your network. The operator will then be able to transfer files without additional authorization from you. If you are in any way unsure about the identity, technical ability or trustworthiness of the operator about to download the Software and do not wish the operator to have access to your computer, click "I do not agree to the terms above."
2. This Agreement does not grant any rights to you in the Software, and you agree not to use, copy, modify, enhance, merge, reverse engineer, reverse assemble, decompile, or in any way alter the Software or any copy, adaptation, transcription, or merged portion thereof or otherwise attempt to derive source code therefrom. You also hereby acknowledge and agree that Elsevier may verify the use of the Software through online verification procedures which may include support session time logging. In addition, you acknowledge that the Software provides for trouble support notification to BeyondTrust in the event of a Software failure.
3. IN NO CIRCUMSTANCES SHALL ELSEVIER, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, EMPLOYEES, CONTRACTORS, RESELLERS, OR LICENSORS OR BEYONDTRUST BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OF ANY TYPE OR KIND (INCLUDING WITHOUT LIMITATION SYSTEM DAMAGE, OR LOSS OF DATA, PRIVACY, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, (i) THE DOWNLOADING OF THE SOFTWARE ONTO YOUR COMPUTER, (ii) THE REMOTE CONTROL SERVICES PROVIDED BY THE OPERATOR(S), (iii) ANY INTERRUPTION TO USE OF THE REMOTE CONTROL SERVICE, OR (iv) ANY CONTENT OBTAINED FROM OR THROUGH THE REMOTE CONTROL SERVICE, EVEN IF ELSEVIER OR BEYONDTRUST FROM WHICH DAMAGES ARE SOUGHT HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
4. This Agreement shall be governed and construed in accordance with the laws of The Netherlands. Any dispute arising in connection with the use of the Software or this Agreement or the breach thereof, shall, in the absence of an amicable solution by the parties, belong to the exclusive jurisdiction of the competent courts in Amsterdam, The Netherlands.
